C-42, namely research, private study, education, parody, satire, criticism, review, or news reporting, as per s.29 of the Copyright Act; and secondly, that the dealing is fair in the purpose of the dealing, the character of the dealing, the amount of the dealing, the nature of the work, available alternatives to the dealing, and the effect of the dealing on the work, as per CCH Canadian Ltd. v. Law Society of Upper Canada, [2004] 1 S.C.R. 339, 2004 SCC 13. The Supreme Court of Canada has stated that fair dealing is an integral part of the Copyright Act, R.S.C., 1985, c.
